Lincoln knew that martial law would be granting the Confederate's their right to defend only themselves, thus, queuing his own governments demands - would make Lincoln guilty of genocide.

^Lincoln himself (if not unaware) knows, that slaves should be part of its own rebellion against the Confederates. Therefore, the only way Lincoln would stabilize the Union, he as president, would be to grant an ad hoc freedom FROM SLAVERY. This follows that Lincoln in all due respect, knew he was not giving freedom to a group of minorities that were being oppressed.
What if: the minority of slaves could somehow FIGHT AGAINST SLAVERY. In essence, slaves were not going to be given the right to protect themselves from being oppressed out of slavery. Lincoln simply prevented rebellion from happening. Making slavery illegal is not the same as acting based on revolution. The Confederates were not fighting to legalize slavery, they were fighting so they would not be persecuted as slave masters. Confederates were acting as outlaws, of which Lincoln was not about to enable, also reflects Lincoln's inaction on the basis of martial law.
If Lincoln would have given absolute freedom BASED on FREEING slaves, in the form of acting against his own government. The intent was to give the Confederates enough cause, they would not have war waged over its own freedom. The main purpose of the Confederate assault, was to condemn slaves, removing slaves from having any chance at having rights PROTECTED. (i.e. protected under law)
The Emancipation Proclamation is Lincolns mercy rule, that gave the Confederates an apartheid. (i.e. its probable cause was removed from existence.) The legalization of slavery is now deemed as trivial in that lost sense of freedom.

^This is a brilliant view of a Red Herring. Lincoln does confirm himself as an abolitionist. Lincoln's use of persuasion, in making a point that he will not sacrifice the allegiance of his military. That directly contradicts everything the Proclamation of Emancipation would gather. He has to be careful, because he would be declaring war on his own country. The law that as it were, being passed into congress, made Lincoln legally take action against the Confederate's. Lincoln is essentially using a Red Herring to say he is not about to declare war on its own people. In doing so, Lincoln would be promoting martial law. This Red Herring is typical use of government made policies, to enable the Emancipation Proclamation. Therefore, it was the act of genocide (Lincoln's strategic boundaries had been set) within its legal parameters, its use of force to be justified, that in its form is prejudicial of the Emancipation Proclamation. The fact Lincoln made this a matter of race against race, quite simply, does not relinquish the objective Lincoln had. If Lincoln's true purpose was to abolish slavery, he would have acted through the use of force, which he does not specify is a cause of the Emancipation Proclamation. If he declares martial law, has Lincoln not given the right to declare war on its own people, giving full apartheid (i.e. The confederate movement) the advantage.
We are living in a world of mock apartheid today. The Emancipation Proclamation does nothing to protect the rights of minorities, it clearly represents an apartheid which is legalized.

^What that means in its EXACTITUDE, is the Confederate's were implementing martial law on behalf of the US government. If Lincoln were to admit that the Confederate's were a legitimate government funded institution, it would remove all cause from his authority over it. Think about it, the Confederate's were no longer "rebels" but were to be known as cohorts, to install the Emancipation only LEGALIZED APARTHEID (think of Israel today) without 1- the use of law enforcement against 2- itself government, which 3- the government essentially was: 4- a warfare based genocide. This only proves that a means against a minority acts as an apartheid.

^Slave masters were compensated on grounds of losing their assets, (i.e. Misappropriation) essentially they were being "refunded" for the slave trade.
